Middlesex County Court Information
The first Middlesex County Courthouse was built in Perth Amboy and was completed in 1717. When the second courthouse was built in 1840, it was built in New Brunswick. The third and current Middlesex County Courthouse was completed in 1959 in New Brunswick.

The County Clerk is an elected position in New Jersey, with a term being 5 years. The County Clerk has many duties, including being the keeper of many records for the county. The office processes passport applications, administers notary public oaths, and processes veteran ID cards. United States District Court
Middlesex County is part of the District of New Jersey for the United States District Court. One part of Middlesex County is served by the Newark division, while the other is served by the Trenton division.

Superior Court
The Middlesex County Superior Court has general jurisdiction over most civil and criminal trials in the county. There are 21 Superior Courts in New Jersey, one for each county.
Municipal Court
Municipal courts have jurisdiction over a variety of minor matters, such as traffic violations and ordinance violations. These courts are often where charges are initially filed against a person before an indictment is returned.
Civil Court
The Civil Division hears cases that are not criminal in nature and usually involve a financial or property dispute between two people. There are multiple court levels within the Civil Division.
Cases involving more than $20,000 are handled in the Civil Division of Superior Court. Cases involving over $5,000 up to $20,000 are heard in the Special Civil Part of the Civil Division. Cases involving up to $5,000 are also heard in the Special Civil Part, but this is better known as small claims.
When monetary damages are not involved in civil cases, these cases are heard in the General Equity Division of Superior Court. These cases include non-jury cases such as foreclosures, trade secrets, and labor issues.
Criminal Court
The Criminal Division handles all criminal cases involving indictments of adults. Juveniles may rarely be waived to adult court, based on the severity of a crime.
Family Court
The Family Division is responsible for cases that arise from a family or similar relationships. Family Court has jurisdiction over divorce, child support, paternity, custody, abuse and neglect, and other family crises cases. Juvenile Court, including juvenile delinquency, falls under the Family Division umbrella.
Veterans Court
Veterans Court is a special program for veterans who have been charged with certain crimes and also struggle with mental illness, substance abuse, or homelessness. With mentors and community resources, this court attempts to address the issues involved.
Veterans who successfully complete the program may have their charges dismissed.
Drug Court
Drug Court is an option for those charged with drug or drug-related offenses. In this program, eligible offenders complete an in-depth drug treatment program, agree to monitoring, and have regular court appearances. Violent offenders are not eligible. For those who complete the program, their records will be expunged.
Middlesex County Surrogate’s Court
Cases involving probate, adoptions, and guardianships are heard through the Middlesex County Surrogate’s Court. The Surrogate can establish guidelines for distributing a deceased person’s estate, appoint guardians, and oversee funds that have been set up for minor children.
